Terms of Service

Please read these Terms of Service carefully before using the services offered by Matify Marketing ("Matify," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Services

Matify Marketing provides digital marketing services, including but not limited to paid advertising management (Meta, Google), lead generation, CRM setup and automation, AI-powered follow-up systems, and related consulting services for real estate professionals and local businesses (collectively, the "Services").

2. Client Agreement & Onboarding

Upon engagement, clients will be onboarded within approximately 7 business days. This includes ad account access, creative development, copywriting, CRM configuration, and automation setup. Client cooperation — including timely provision of access credentials, branding assets, and market information — is required to meet this timeline.

3. Fees & Billing

Our Services are billed on a monthly basis at the rate agreed upon in your service agreement. All fees are due in advance of the service period. We do not guarantee specific results, lead volumes, or closing numbers. Past performance of our systems does not guarantee future results.

Payments are processed via the method selected during onboarding. Late payments may result in a pause in services until the account is brought current.

4. Month-to-Month Service

Unless otherwise specified in a separate signed agreement, all Services are provided on a month-to-month basis. Either party may terminate the agreement with written notice. No refunds are provided for partial months.

5. Ad Spend

Where applicable, advertising spend is managed in client-owned or agency-managed ad accounts. Clients are responsible for ad spend billed directly by the advertising platform (e.g., Meta, Google). Matify's management fee is separate from and in addition to any ad spend.

6. Intellectual Property

All ad creatives, copy, funnels, automation workflows, and systems built by Matify remain the intellectual property of Matify Marketing until full payment is received. Upon payment, clients receive a license to use these materials for their own business. Matify reserves the right to reuse frameworks, templates, and methodologies across multiple clients.

7. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information disclosed during the engagement. This includes but is not limited to ad performance data, client lists, pricing, and strategic plans.

8. Limitation of Liability

Matify Marketing is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the Services. Our total liability shall not exceed the amount paid by the client in the 3 months preceding the claim.

9. No Guarantee of Results

We make no guarantees regarding specific outcomes, including but not limited to lead volume, appointment bookings, or closed transactions. Results shared on our website, in testimonials, or in sales materials represent past performance and are not indicative of future results for any specific client.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of the Services constitutes acceptance of the revised Terms.
